Künftig ist damit für alle nicht bloß verfahrensleitenden Rekurse die Rekursbeantwortung gemäß § 521a ZPO vorgesehen.
Die zentrale Bedeutung des Grundsatzes des rechtlichen Gehörs für ein faires Verfahren ist, seit langen bekannt. Dieser Grundsatz findet seinen Ausdruck in der bekannten lateinischen Formel „audiatur et altera pars“ . Zufällig-treffend wurde das rechtliche Gehör auch einmal im Urteil der Regierung von Niederösterreich vom 25.8.1568 als „Grundrecht“ bezeichnet.
Der Anspruch auf Gewährung rechtlichen Gehörs warfare, wenn auch nur ausdrücklich für das streitige Verfahren, bereits in den §§ 477 Abs 1 Z four und 529 Abs 1 Z 2 der Stammfassung der ZPO von 1895 verankert. Dieser Grundsatz enthielt in Österreich vor der Erhebung der MRK in den Verfassungsrang keine verfas-sungsrechtliche Garantie, während in Deutschland der paintings 103 Abs 1 GG sowie die entsprechenden Bestimmungen der Landesverfassungen den Anspruch auf rechtliches Gehör als grundrechtsgleiches Recht garantieren. Allerdings wurde diesem Grundsatz im österreichischen Recht durch einfachgesetzliche Regelungen, die jedoch nur in der 1. Instanz diesem Postulat vollumfänglich Rechnung trugen, entsprochen. Kodek wies zu Recht darauf hin, dass gerade im Bereich des Rechtsmittelverfahrens, insbesondere im Rekursverfahren, das im Hinblick auf die „typischerweise geringe Bedeutung der angefochtenen Entscheidung“ anfänglich einseitig ausgestaltet struggle, Defizite bestünden. Auch wenn mit der Zivilverfahrens-Novelle 1983 in einigen Fällen die Zweiseitigkeit auch in das Rekursverfahren eingeführt wurde, so blieb es im übrigen trotz der geäußerten Kritik beim einseitigen Rekursverfahren. Insbesondere von Ballon erfolgte der zutreffende kritische Hinweis, dass die bedenkliche Rechtslage im Bereich des Au-ßerstreit-, Insolvenz- und Exekutionsverfahrens damit aber nicht beseitigt wurde.
Ein Umdenken setzte mit der Entscheidung des EGMR vom 6.2.2001 ein, da der traditionelle Grundsatz der Einseitigkeit des Rekursverfahrens ins Wanken geriet.
